Welcome to SwiftStack. These Terms of Service ("Terms") govern your access to and use of the website, applications, products, and services (collectively, the "Services") offered by SwiftStack ("SwiftStack", "we", "us"), whose applications and operations are based in the State of Texas, United States of America. By accessing or using the Services, you ("User" or "you") agree to be bound by these Terms.

1. Acceptance of Terms

By registering for, purchasing, or using the Services, you represent that you have the legal capacity to enter into binding contracts and that the information you provide is accurate and complete.

2. Description of Services

SwiftStack provides digital infrastructure, B2B SaaS web applications, VoIP telephony, ERP/CRM integrations, and technology consulting. We reserve the right to modify, suspend, or discontinue any Service at any time, with reasonable notice where possible.

3. User Accounts

• You are responsible for keeping your credentials confidential.
• You are responsible for all activity under your account.
• You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Services for any unlawful purpose or in any way that infringes the rights of others. The following are prohibited, without limitation:

• Probing or breaching system security without authorization.
• Distributing malware, spam, or unlawful or infringing content.
• Reverse-engineering, reselling, or sublicensing the Services without authorization.

5. Intellectual Property

All software, code, design, trademarks, and content of the Services are owned by SwiftStack or its licensors. These Terms grant you only a limited, revocable, non-exclusive, non-transferable license to use the Services.

6. Plans, Payments, and Subscriptions

Paid Services are billed on a recurring basis according to the selected plan and renew automatically unless otherwise stated. Refunds are governed by our Refund Policy.

7. Third-Party Links and Services

The Services may contain links or recommendations to third parties, including affiliate links. SwiftStack does not control and is not responsible for the content or practices of such third parties.

8. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, SwiftStack shall not be liable for indirect, incidental, special, or consequential damages. Our total aggregate liability shall not exceed the amount you paid during the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold SwiftStack harmless from any claim or expense (including reasonable legal fees) arising from your misuse of the Services or breach of these Terms.

11. Termination

We may suspend or terminate your access upon breach of these Terms. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, United States of America, without regard to its conflict-of-laws rules. Any dispute shall be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Texas, and you consent to such jurisdiction and venue.

13. Changes

We may update these Terms from time to time. The current version will be posted on this page with its update date. Continued use after changes constitutes acceptance.
